Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and Good Peak LLC, a New York limited liability company ("Good Peak," "we," "us," or "our"), governing your access to and use of the Buck mobile application, including any related websites, features, and services (collectively, the "App" or "Service").
By downloading, accessing, or using Buck, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use Buck. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement and consent of a parent or legal guardian. By using Buck, you represent that you meet these requirements.
2. Description of the Service
Buck helps users save, organize, and follow through on content they intend to revisit — including links, screenshots, and shared items from third-party platforms such as Instagram, TikTok, and Apple/Google Maps. The App uses automated categorization (including AI-based analysis via a third-party AI provider) to help organize saved items.
AI-Generated Content Disclaimer. Buck uses artificial intelligence (via the Anthropic API) to analyze screenshots and shared content and to auto-categorize saved items. AI-generated categorization, tags, and summaries are provided for convenience only and may be inaccurate, incomplete, or unexpected. You should independently verify any information you rely on.
3. Accounts
You must sign in using Sign in with Apple (or another supported authentication method) to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Billing
Certain features of Buck require a paid subscription ("Subscription"). Current pricing is displayed in the App prior to purchase.
Subscriptions are billed and processed through Apple's In-App Purchase system. Apple, not Good Peak, processes your payment, and Apple's own terms and payment methods govern the transaction.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your Subscription at any time through your Apple ID account settings.
Any free trial period will convert automatically to a paid Subscription unless canceled before the trial ends.
All fees are non-refundable except as required by law or Apple's refund policies. Refund requests must be directed to Apple, as Good Peak does not have the ability to issue refunds for App Store purchases.
We may change Subscription pricing prospectively; existing subscribers will be notified in advance of any change as required by applicable law.
5. User Content
"User Content" means any content you save, upload, share, or otherwise submit through Buck, including screenshots, links, notes, and categorization data.
Ownership. You retain all ownership rights in your User Content.
License to Us. You grant Good Peak a limited, non-exclusive, royalty-free, worldwide license to host, store, process, and display your User Content solely as necessary to operate and improve the Service (including AI-based categorization).
Your Responsibility. You are solely responsible for your User Content and for ensuring you have the necessary rights to save and share it through the App, including compliance with the terms of any third-party platform (e.g., Instagram, TikTok, Google Maps) from which content originates.
Third-Party Content. Buck may allow you to save or reference content originating from third-party platforms. We do not claim ownership of that content, and your use of it remains subject to the applicable third party's terms of service.
6. Acceptable Use
You agree not to:
Use Buck for any unlawful purpose or in violation of any applicable law or regulation;
Upload or share content that infringes intellectual property rights, is defamatory, obscene, or otherwise unlawful;
Attempt to reverse-engineer, decompile, or extract source code from the App, except as permitted by law;
Interfere with or disrupt the App's infrastructure, security, or normal operation;
Use automated means (bots, scrapers) to access the App without our prior written consent;
Misuse the App's AI features to generate harmful, abusive, or illegal content.
We reserve the right to remove content or suspend/terminate accounts that violate this section.
7. Intellectual Property
The App, including its design, branding, software, and underlying technology (excluding User Content and third-party content), is owned by Good Peak LLC or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use Good Peak's trademarks, logos, or brand assets without prior written permission.
8. Third-Party Services
Buck integrates with or relies on third-party services, including but not limited to Apple (authentication, payments, App Store distribution), Supabase (data storage), Anthropic (AI processing), and RevenueCat (subscription management). Your use of these integrations may also be subject to the applicable third party's own terms and privacy policies. We are not responsible for the acts, omissions, or availability of third-party services.
9. Privacy
Our collection and use of your personal information is described in our [Privacy Policy], which is incorporated into these Terms by reference.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF AI-GENERATED CATEGORIZATION OR ANY OTHER OUTPUT OF THE APP.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOOD PEAK LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Good Peak LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your User Content, or your violation of these Terms.
13. Termination
You may stop using the App and delete your account at any time through the in-app account deletion feature. We may suspend or terminate your access to the App at our discretion, including for violation of these Terms, with or without notice. Upon termination, your right to use the App ceases immediately; certain provisions of these Terms (e.g., IP, disclaimers, limitation of liability, indemnification) survive termination.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the App shall be resolved in the state or federal courts located in New York, New York, and you consent to the exclusive jurisdiction of those courts.

16. Apple App Store Terms
Because Buck is distributed via the Apple App Store, the following additional terms apply:
These Terms are between you and Good Peak LLC only, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to furnish maintenance or support for the App.
Apple is not responsible for addressing any claims by you relating to the App.
Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list.
